Know how to build a truck crash defense

When there is a semitruck crash, some of the occupants of the other vehicle might decide that a claim for compensation is in order. One thing that is often troubling about these is that they are often seeking exorbitant amounts, which can be detrimental to your company. It is imperative that you think about what you can do to defend your business against the claim.

A possible place to turn for the starting point to your defense is the logbook. This is the document that can let you know when the trucker was driving. It is your opportunity to ensure that your driver was in compliance with the Hours of Service regulations, which is especially important if trucker fatigue is one of the factors that is being claimed in the wreck.

If you notice any inconsistencies or other issues with the logs, you need to find out what is going on. If everything is in line with the logs, you can look into starting to combat other claims that are being made against your company.

Remember, your driver will need to have a drug test after the accident. This can provide some information about whether impairment was a factor; however, you have to look past that information and dig a bit deeper. Some medications, such as antihistamines, won’t show up on the test. You should discuss the crash with your trucker to determine if they did take anything prior to the crash. If they didn’t and the drug test is clean, you can also use that information in the defense.
